    So many have come forward & Diddy producing tapes, etc to “bring everyone down with him” just validates how much the industry MUST change.     I am so disgusted and disappointed in that a "powerful" person is able to get so and be able to use it to trample all over another human being. I'm restraining myself because I would most likely be arrested or sued myself. I hope he loses everything but with the way things tend to go in the predators direction unfortunately what she got is what she gets. He has gotten away with too much. What if he still has those videos or is doing this to someone else, or worse grabs someone off the street and does it. I get you can't prevent crime but omg. I didn't think people could be worse than what I have seen before this.

    Celebrities should have more restrictions. There should be a clause in their contracts that they cannot date clients etc. doctors, social workers, dentists etc cannot date their clients. If they did they could be struck off. There is a huuuge power imbalance between celebrities and those that work for them or their fans. I think there should be some sort of legislation that protects individuals from this.

    Incredible take down! Because she sued him and his corporations (multiple) as an “employee”, it opened the door for the corporate insurance company to take over. This is why they settled so quickly. What a clever strategy. They targeted the insurance (commercial liability policies & directors and officers policies)…brilliant move! Also, New York law states that because they settled this harassment lawsuit in under 21 days, there is no legal and binding NDA. Therefore, Cassie is free to further expose all the details that she did not include in the lawsuit. Perhaps a book will be coming soon?

    Unlike in the Depp/Heard case, there are multiple women suing Diddy. Depp had nobody in his past coming claiming abuse. Men and women both are confirming Cassie's claims. Nobody but Amber and her sister in Depp's case. Cassie sued Diddy to bring the abuse out in the open and make him accountable. Depp sued Amber to expose her lies about the abuse and make her accountable. Night and day.

    You made a grave and dangerous misstatement, especially surprising from a former prosecutor.

    A party can NEVER sign away participation in a criminal case as part of settling a civil suit. There are three main reasons for this: one, a civil settlement is essentially a bilateral contract (promise to pay in exchange for promise to act or fail to act). If it were legal to contract not to report a crime or even act as a witness thereto (as you suggested here), a person could easily be pressured (without further recourse) into employment contracts that violate safety laws or those governing wage and hour protections or call for an employee to otherwise break the law. All of this was settled as a matter of law by the Slaughterhouse cases.

    Second, a civil settlement is only as good as a government is willing to enforce its execution. This settlement here, for example, hasn't yet been updated in PACER because it still requires a judge to review and approve it before it becomes official. The judge checks first for unconscionable/onerous terms but also has the power to strike any provisions that are contrary to law or public policy — e.g., a promise not to criminally prosecute on the same set of operative facts. This reliance on the courts to give life to a civil settlement brings the contract within the realm of the 14th amendment, per the Heart of Atlanta Motel case. And since the government won't be a party to illegality, and the government is a silent party in every contract, no contract can contain a provision seeking to conceal crime.

    Third, most (if not all) states have moved away from the model of citizens pressing criminal charges, especially in the realm of domestic violence. Instead, the state has absolute say — as a matter of public policy — whether to prosecute, independent of whether a victim(s) agrees to cooperate as a witness. The state may decline to prosecute if it is unable to assemble sufficient evidence to prove a crime beyond a reasonable doubt in absence of a victim's help. But by taking the decision altogether out of a victim's hands, abusers can't rely on intimidating their victims over and over again to keep themselves out of facing the justice system.

    Sorry so long. It's just that given that Lawnerds care about this issue a great deal, and trust you as an authority on all things legal, I thought it urgent to address this misstatement right away. Thanks.
