Time should not matter when it comes to holding all responsible conspirators. The state had nothing to begin with and only with time did they learn more. Prosecutors have a heavy burden to get a conviction.

Donna is really worried about the jury's reaction to fleeing and with good reason. I can't see the judge suppressing this vital fact especially since she was arrested at MIA.
