    The bankruptcy court is a court of equity not a court that can pursue reparations with regard to criminal activity. Only the owner of an item can sue to have it returned. The bankruptcy court cannot do it for them. Only the state or The criminal prosecution arm of the federal government can seek punishment with regard to cries. The bankruptcy court only deals with assets as they protain to the equitable statues setting forth specific procedures that the bankruptcy Courts follow

    Clients can negotiate on the issue of whether costs are deducted from a gross settlement amount before or after attorney fees. I deduct them first which means the attorney fee is calculated on a smaller amount.

    It seems to me that, at minimum, that the party paying the settlement should be required to notify the plaintiff (maybe via a certified form letter) and the court within 48hrs of the deposit of funds. Withdrawals of funds from the trust account should be simultaneous; do the math first and cut three checks (or direct deposit): costs, fees, and settlement.

    Hey Emily… what I would like to know is why the law firm just didn’t hire an accountant to account for every single dime and why would Erika know this stuff and she’s not an employee to begin with? The attorneys at the firm working alongside Tom do definitely know. I’m guessing an accountant wasn’t hired so they could all do and get away with all the illegal things they were doing.

    I hate to say this but I think G & M’s cases may be the tip of the iceberg. If the system has such loopholes then those with little or no integrity/decency so inclined to exploit those loopholes will do so. Furthermore the legal profession is not alone as I suspect corruption is common currency to any profession or vocation where large amounts of money are involved.

    This kind of stuff (attorney stealing funds) has been going on for years rather it’s a little bit or a grossly exorbitant amount and regardless of the amount it’s disgusting. I think that the primary tenet of an attorney/client relationship is to be a fiduciary representative for their client. Fiduciary being the key word here. I’ve been in litigation for 27+ years and almost exclusively in defense litigation.. I spent about 5 minutes working in plaintiff litigation and saw enough that I had enough disgust to last a lifetime. While it can happen on both sides, I think that deplorable part about it happening on the plaintiff’s side that these people come to these guys desperately needing assistance usually and they are compelled to put their trust in their attorney. The fact that you can take from these people that have placed their trust in you to help them at their most desperate time is the worst possible thing you can do to someone. I hope each of his victims get justice of some kind.

    They should have an episode of Housewives where Erika goes to an Indonesian orphanage and demands the money back from one of the children there who lost their parents. They might even owe her money if they only got a percentage of $220000 and they have to all totally repay the $750000.

    Replay here and both Girardi and Murdaugh are just as shocking, both cases involved deaths, money, and damages cause to victims familys for the benefit to a lawyer.
