What's left to be done re evidence, forensics, etc.? Those who were mostly absent from the court filings, I think. Seth Kenney may still be under some sort of investigation – just the small amount we saw about Seth and Sarah was rather weird.

  • @alisonturleyzavcer6007

Please do an update on Rust.

  • @jediping

The filming resuming feels so gross. Her husband being involved is just confusing. I cannot imagine a world where I would agree to that in the same circumstances. Unless it was part of some sort of settlement, I guess. I assume his role is honorary, rather than having any responsibilities. I wouldn’t want to spend any more time with the people responsible for my partner’s death than it would take to sue them for every dime they possessed.

  • @joceery

I really hope they will recharge him! the investigator brief made it more than clear that he has to. it's sad if they let it get under the rug.

  • @Bound4Earth

So glad to see the prosecution come to their senses. If you want to charge him with negligence as a producer or some other aspect fine, but allowing one of the two people that you admit were directly responsible for clearing the gun to to plead out of charges, just so you could make an example and nail Alec Baldwin was bankrupt morals in the first place.

It proves that the prosecution is either ignoring how movie sets work or actively does not care about facts or who is actually responsible and is trying to demonize Alec anyway.

The waters were made muddy by jackass losers chasing clout like George Clooney arguing he always checked the gun, no he did not. That would be a safety violation and the armorer would have to come back in and recheck the gun. When you have people in positions that exist to ensure safety they are supposed to do their job two people failed to check the weapon and the prosecution allowed one of them to go free. Where is the justice?

  • @JaneDoe-vi5yc

Emily, BBC just posted this: "Rust weapons supervisor was likely hungover on set, prosecutors claim." I'm pretty sure you know this already cuz you really have your fingers on the pulse of — EVERYTHING!

  • @musicismagic3001

I am absolutely confused by this entire settlement!

  • @valleygirl2530

    P. S. Why wouldn’t Elena’s family want to file and prevail in a wrongful death lawsuit? The defendant is Baldwin right? I remember when Nicole Simpson’s family filed and won their wrongful death suit against OJ Simpson. It’s the only “win” the victims’ families could have after he was acquitted. Of course they never got any money from Simpson but that wasn’t their main goal.

  • @valleygirl2530

WTF Emily? I’m stunned by hearing that Baldwin won’t be prosecuted – now. Why wait? I think this sets a bad example for the public who believes in consequences for bad acts. It sounds simplistic but a delayed prosecution is like no consequences for his negligence. My Answer: That hollow statement is transparent in its attempt to convince potential marketers to support the film. They don’t give a shit about Helena or her family or anyone else. The only motive is financial and that’s Hollywood.

  • @kimmyball4961

Several thoughts. Where in the hell did the bullet come from?? Is her husband being bought off by being made an EP?? And in what light does that put him ?? One more…..money can do wonders 😢

  • @Tichaba124

    Yes, please continue this!

  • @cherylbaker3319

I'll be on the rewatch crew due to being beautifully distracted by the Emilys showcase new hair which is just SLAAAAYING me throughout. love the darker toned amethyst, the sharper layered bob, it gives the Emily edge even more edge and I AM HERE FOR IT TWICE!

  • @Spoonie

Now I see why they want to finish the movie, it will support the victim’s family… it’s still a tough choice

  • @lisaanderson2488

This movie going forward is disrespectful and disingenuous.
90% of the profits after costs should go to the dead woman. All of AB should go to her family. The woman is dead. Killed during the filming. How do they even fathom making the movie?
    Weird and extremely awkward.

  • @Somegirl811

You crack me up so hard, and by the way your hair looks so pretty and shiny. I'm definitely going to see this movie!

  • @lightwarrior7856

Curious: how do you feel about The Crow being produced and released?

When you said your opinion, I couldn't help but think of this movie and had to click away from the video to refresh my memory on how exactly Brandon Lee was killed. I was flabbergast at what I heard and could not believe that the sheer negligence did not lead to any charges being brought against the culpable.

Nevertheless, I agree with the movie being produced. Watching Brandon's final interview and the impact the movie had on him–his recognition of the importance of the small things in life, how we never know when we are going to go, and how our perception is that of limitless experience despite the reality having a limited number placed that we have no knowledge of–was just surreal. It would have been a disservice to his memory to not follow through and let the message of the film be seen, imho.

Just a related tangent. Still, I have no interest in seeing Rust, myself. Lol. Ironic? IDK. Perhaps it just isn't my cup of tea.

  • @DestructionDUCKY

Idk. It does feel weird rhat theyre continung filming. Part of me doesnt want to see it. Also wonder what the directors thoughts are ? Joel Sousa ? He also got injured.

  • @savyjett

Am i paranoid, or is anyone else feeling leery about the other cases the state has brought to trial?

  • @corinariginals

As a New Mexico film worker I'm so grateful for your coverage of this tragedy. Thank you!

  • @misfitGazelle

Thank you for the continuing coverage Emily 💜

  • @NLSmith-qe4sg

I have never thought it was fair they charged him. It’s a great tragedy, but he should not be he’ll couple more for some thing when he didn’t have control of the gun and the one who was killed told him to aim at her chest. I think they felt like they had no choice but to charge him because he was famous, and people would say there was a problem if they didn’t. But I think it was totally unfair.

  • @Bavoratu

No doubt the movie being still made is because it was the victims project and the people who knew/close to her wants to finish what she started, including all the cast.

Hell I'd watch this movie, nobody else needs to see it if they don't want to, the choice is theirs.

  • @AltairEgoX

Hannah should be held responsible entirely…how he as at fault for any of this is unfortunate and really sus. its a slippery slope when the guy eating is the guy in charge of the whole project. he is negligent for trusting the people he hired to do there damn jobs lol just wow!

  • @Ocrilat

Consider this possibility. The prosecution was always going to drop the charges. Why? Because the crime they can charge Baldwin with he doesn't meet the requirements for. Three people were in this chain of events. Two (the armorer and the assistant director) both failed in their duties as far as safety goes. They both didn't do their jobs, and at least the AD lied to pretend he did ("Cold Gun"). Baldwin followed all the safety procedures required of him.

New Mexico says: Involuntary manslaughter consists of manslaughter committed in the commission of an unlawful act not amounting to felony, or in the commission of a lawful act which might produce death in an unlawful manner or without due caution and circumspection.

They can't charge him with manslaughter because Baldwin doesn't meet the standard. Note a person that follows all the safety procedures isn't 'without due caution and circumspection'.

I'm sorry, but some people were so caught up in hoping beyond hope that Alec Baldwin would go to jail that it clouded their judgement. I doubt there was 'new information'. And I also doubt there will be new charges. 'New information' was to save face. Both the armorer and the AD should have been charged, and they both would have almost certainly been found guilty (since if either did their job, there would have been no accident). The shame is they almost certainly gave the AD a sweetheart deal to prosecute Baldwin…for something they couldn't convict Baldwin on.

On the 'maybe the condition of the gun doesn't matter with the armorer', it was her job to maintain and inspect the guns to make sure they worked properly. It matters.

  • @stephaniew4140

Of course they will make the movie. Whenever tragedy has occurred in the context of making art – or even just making advertisement commercials – the show goes on. Because, well, the show must go on.

  • @DDeCopas

Always treat the gun as loaded.
Always keep the gun pointed in a safe direction.
Always keep your finger straight and off the trigger until you are ready to shoot.
Always keep the gun unloaded until you are ready to use it.
Never point the gun at anything you don't intend to destroy.
    (…)
the first 5 of the 12 rules.

  • @jenstroh1711

No longer have any interest in Alec Baldwin or this movie.

  • @DS40764

I think it's weird, that they want to finish the film, but , things come down to money a lot (a reality). Also, maybe the deceased would have wanted the movie to be completed. We do things on behalf of others, a lot. They have a young son and a lifetime of lost earnings won't be there. With Baldwin in jail, and no movie, not much in terms of money. Baldwin has many kids too. And some of your readers here hinted to contracts ,etc. Well, I believe the producer did the right think in taking partial accountability and Reed, will have to also, but it saddens me that B may not have to and he fired the shot. Who handles a gun like that, with no responsibility?
